These Terms of Service apply when you use the Bull Proof website or purchase from us. By placing an order, you agree to these Terms and the policies linked on our website, including our Shipping Policy, Returns and Refunds Policy, Privacy Policy and Purchase Options Cancellation Policy where applicable.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
1. About us
This website is operated by Bull Proof. In these Terms, “Bull Proof”, “we”, “us” and “our” refer to Bull Proof Pty Ltd 35 658 638 512, trading as Bull Proof.
Our online store is hosted by Shopify, which provides the ecommerce platform used to offer our products and services.
2. Using our website
You may use our website only for lawful purposes. You must not:

interfere with the website’s operation or security;

introduce malicious code;

scrape, copy or exploit website content without permission;

submit false, misleading, unlawful or abusive content;

impersonate another person; or
-
infringe our rights or the rights of others.
You must be legally able to enter into a purchase contract. If you are under 18, a parent or guardian must place or approve the order.
We may suspend or block access where reasonably necessary to protect customers, Bull Proof or the website, or where these Terms are breached.
3. Product information
We aim to keep product descriptions, specifications, images, availability and pricing accurate. Minor differences may occur due to screen settings, manufacturing changes or product improvements.
Measurements and specifications should be checked before purchase. Images may show accessories, vehicles or other items that are not included. The product listing and order confirmation determine what is included.
We may correct genuine errors or update product information. If a material error affects an order, we will contact you before fulfilment and offer an appropriate correction, alternative or refund.
4. Product suitability, fitment and installation
You are responsible for checking that a product is suitable for your intended use, vehicle, roof-rack system and installation location before ordering or installing it. This includes checking:

dimensions, mounting points and compatibility;

the vehicle manufacturer’s limits and instructions;
-
roof, rack and dynamic and static load ratings;
-
legal, registration and road-safety requirements; and
-
whether professional installation is required.
Load limits must not be exceeded. The lowest applicable rating in the vehicle, roof, rack, mounting hardware or product system should be followed.
Products must be installed, secured, used, inspected and maintained in accordance with the supplied instructions and applicable law. Where you are not suitably experienced, use a qualified installer. Stop using a product if it appears damaged, loose, incorrectly fitted or unsafe.
General website information is not a substitute for vehicle-specific or professional advice. Contact us before purchase if you are unsure about compatibility. Nothing in this section limits your rights where our product or advice fails to meet a consumer guarantee.
5. Prices and payment
Prices are shown in Australian dollars and include GST where applicable unless stated otherwise. Shipping and optional services are added at checkout or quoted separately.
Prices may change before an order is accepted. A price change will not affect an accepted order unless there was an obvious or genuine error, or you approve a change to the order.
You must provide current and accurate billing, contact and payment information. By submitting payment details, you confirm that you are authorised to use that payment method.
Manual freight quotes are subject to the validity period stated in our Shipping Policy or on the quote.
6. Orders
Submitting an order is an offer to purchase. An automated acknowledgement confirms that we received the order; it does not necessarily mean we have accepted it. Acceptance occurs when we confirm the order for fulfilment or dispatch it.
We may reasonably reject or cancel an order before fulfilment where:

the product is unavailable;

pricing, description or shipping information contains a genuine material error;

payment is declined or cannot be verified;
-
we reasonably suspect fraud, unlawful activity or unauthorised resale;
-
delivery cannot be safely or practically arranged; or
-
quantity limits apply.
If we cancel an order after payment, we will refund the affected amount unless the payment is subject to a lawful hold or dispute. We will try to contact you using the details provided.
Requests to change or cancel an order are not guaranteed once processing has started. Pre-orders, subscriptions and try-before-you-buy purchases are also governed by our Purchase Options Cancellation Policy.
7. Shipping and collection
Delivery charges, carrier selection, tracking, depot delivery, site access, unloading and redelivery are governed by our Shipping Policy.
Large items are generally delivered to the nearest suitable freight depot unless another service is requested, quoted and paid for. Business or home delivery may require suitable unloading equipment or a paid tailgate service.
Delivery dates are estimates unless expressly guaranteed in writing. You must provide accurate delivery and contact details and promptly advise us of any error.
Ownership of goods passes to you when full payment is received. Responsibility for loss or damage passes as determined by applicable law and the agreed delivery arrangement. Nothing in these Terms limits our obligations where goods are lost, damaged or not delivered as agreed.
8. Returns, refunds and consumer guarantees
Returns, change-of-mind requests and warranty claims are handled under our Returns and Refunds Policy.
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, you may be entitled to a repair, replacement, refund, cancellation or compensation where a product or service does not meet a consumer guarantee.
We may ask for reasonable proof of purchase and information needed to assess a claim. Any voluntary manufacturer or Bull Proof warranty is additional to your automatic legal rights.
9. Accounts
If you create an account, you are responsible for keeping your login details secure and for activity performed through the account. Tell us promptly if you suspect unauthorised access.
We may suspend or close an account where reasonably necessary because of fraud, misuse, security risk or a material breach of these Terms. Closing an account does not remove rights or obligations relating to existing orders.
10. Reviews, comments and submissions
Content you submit must be accurate, lawful and based on your genuine experience. It must not infringe intellectual property, privacy or other rights, contain malicious code, or be defamatory, discriminatory, threatening or obscene.
You retain ownership of your content. By submitting it for publication, you give Bull Proof a non-exclusive, royalty-free licence to use, reproduce and display it for operating and promoting our business. You may withdraw this permission for future use by contacting us, where reasonably practicable and subject to legal recordkeeping obligations.
We may moderate or remove content that breaches these Terms or applicable law.
11. Intellectual property
The website and its content—including branding, text, graphics, photographs, videos and layouts—are owned by or licensed to Bull Proof and protected by intellectual property laws.
You may view and use the website for personal shopping and product information. You must not reproduce, modify, distribute, sell or commercially exploit our content without written permission, except as allowed by law.
12. Third-party services and links
Our website may use or link to services operated by third parties, including Shopify, payment providers, carriers and social platforms. Their own terms and privacy practices may apply.
We are not responsible for an independent third-party website or service that we do not control. This does not limit any responsibility Bull Proof has for providers we use to fulfil our obligations to you.
13. Privacy
We handle personal information in accordance with our Privacy Policy and applicable privacy law. Payment details are processed by authorised payment providers and are subject to their security and privacy practices.
14. Website availability
We aim to keep the website secure and available, but access may occasionally be interrupted for maintenance, updates, technical issues or events outside our reasonable control.
To the extent permitted by law, we do not guarantee that the website will always be uninterrupted or error-free. We will take reasonable steps to correct material issues we control.
15. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
To the extent permitted by law, Bull Proof is not liable for loss caused by:

your misuse, unsafe installation or use contrary to instructions;

inaccurate information supplied by you;
-
unauthorised changes to a product;
-
failure to check vehicle or equipment load limits; or
-
an independent third-party website or service outside our control.
Where liability can lawfully be limited, our liability will be limited to the extent reasonable in the circumstances and, where permitted, to resupplying the relevant goods or services or paying the reasonable cost of doing so.
This section does not limit liability for fraud, wilful misconduct, personal injury caused by negligence, or any Australian Consumer Law remedy.
16. Your responsibility for misuse
You are responsible for reasonable loss Bull Proof suffers because of your unlawful use of the website, deliberate infringement of another person’s rights, fraud, or material breach of these Terms. This does not make you responsible for loss caused by Bull Proof or beyond your reasonable control.
17. Changes to the website and these Terms
We may change products, prices, website features or these Terms from time to time. Changes apply prospectively from the date published unless the law requires otherwise.
Changes will not remove rights or materially alter an accepted order without your agreement, except where reasonably required by law. The version applying to an order is generally the version published when that order was placed.
18. Ending access
You may stop using the website at any time. We may restrict access where reasonably necessary because of a security risk, unlawful conduct or material breach of these Terms.
Ending website access does not affect accrued rights, existing payment obligations, accepted orders or provisions intended to continue, including intellectual property and dispute rights.
19. Governing law
These Terms are governed by the laws of Victoria, Australia. The parties submit to the courts of Victoria and any courts entitled to hear appeals from them, subject to any mandatory rights you have to bring a claim elsewhere.
If any provision is unlawful or unenforceable, it will be read down where possible or otherwise severed. The remaining provisions continue to apply.
Our failure to enforce a provision immediately does not waive our right to enforce it later.
